This document contains information about personal data processing provided to data subjects in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation or GDPR).

3. Purpose of and Legal Basis for the Processing of Personal Data

Personal data provided by data subjects by means of this website (for the purpose of subscribing to a newsletter) are processed on the basis of consent granted by the data subject. In such a case, the data subject has the right to withdraw his or her consent at any time. The withdrawal of consent does not affect the lawfulness of processing based on consent before its withdrawal.

  • I will process your personal data only on the basis of a valid legal reason, namely legitimate interest, fulfillment of a contract, legal obligation or consent granted,
  • I fulfill the information obligation according to Article 13 of the GDPR even before the processing of personal data begins,
  • I will enable and support you in fulfilling your rights under the Personal Data Protection Act and the GDPR

4. Categories of Personal Data Concerned

Personal data that are processed include, in particular, the full name, date of birth, address, e-mail address, phone number.

I process the personal data you entrust to me for the following reasons (to fulfill these purposes):

  • Fulfillment of the contract
    • Your personal data in the scope of: name, surname, delivery and billing address, e-mail, telephone number. I absolutely need this data to fulfill the contract, e.g. to deliver services and communicate with you.
  • Accounting management
    • If you are a customer, I absolutely need your personal data (invoicing data) to comply with the legal obligation to issue and register tax documents.

The website at www.lenkahamerska.cz uses cookies to be able to monitor visitors’ preferences and create optimized web pages accordingly. Cookies are small files that are stored on your hard drive. To ensure specific processing operations that I cannot provide by myself, I use the services and applications of processors that specialize in the given processing.

It is possible that in the future I will decide to use other applications or processors to facilitate and improve the quality of processing. However, I promise you that in such a case I will place at least the same demands on security and quality of processing on the processor as before.

I process data exclusively in the European Union or in countries that ensure an adequate level of protection based on the decision of the European Commission.

9. Rights of the Data Subject

The data subject has the right to obtain confirmation as to whether or not personal data concerning him or her are being processed, and, where that is the case, access to the personal data and other information mentioned in this document.

The data subject has the right to obtain the erasure of personal data concerning him or her without undue delay where so provided for in the GDPR unless the processing is necessary for the establishment, or for the performance of a task carried out in the public interest or in the exercise of official authority vested in the controller.

The data subject has the right to obtain restriction of the processing of his or her personal data where so provided for in the GDPR. Such data may then only be processed with the data subject’s consent or for the establishment, exercise, or defense of legal claims or for the protection of the rights of another natural or legal person or for reasons of important public interest.

The data subject has the right to receive the personal data concerning him or her that he or she has provided, in a structured, commonly used, and machine-readable format, and has the right to transmit those data to another controller where the processing is based on the data subject’s consent.

Right to portability

The data subject has the right to object at any time to processing that is based on the legitimate interests or a third party interests or is necessary for the performance of a task carried out in the public interest or in the exercise of official authority.

Right to erasure (to be forgotten)

Your other right is the right to erasure (to be forgotten). In this case, I will delete all your personal data from my system and from the system of all sub-processors and backups. I need 60 days to secure the right to erasure. However, the aforementioned rights of data subjects may be restricted for reasons arising from legal regulations.

10. Confidentiality

I would like to assure you that the collaborators who will process your personal data are obliged to maintain confidentiality about personal data and about security measures, the disclosure of which would endanger the security of your personal data. At the same time, this confidentiality continues even after the end of contractual relations with me. Without your consent, your personal data will not be released to any other third party. These personal data processing policies are valid from 11/10/2023.
